Can I Sell My San Jose House Before Foreclosure?

If a trustee's sale is scheduled, tell us the date right away so we can try to close before it.

Often, yes. You may still be able to sell before a California mortgage trustee’s sale if there is time to address the payoff and title work and complete closing. USA Home Buyers buys houses as-is in San Jose. City-level boundary sources differ at a small edge, so confirm whether the exact property’s records route through Santa Clara or Alameda County before using county-specific records.

How we help you work toward closing

We buy houses as-is, in any condition — no repairs, no cleaning, no cleanout required to sell to us.

We put the offer and terms in writing before you commit. If you choose to move ahead, closing is through a title company, which reviews title and payoff details with the parties. The current trustee-sale date and required payoff still have to line up for a closing before the sale.

When you sell to us, we pay the closing costs, including the county documentary transfer tax and any city transfer tax. That does not include your mortgage payoff, liens, back taxes, or your share of current property taxes; those are separate amounts.

Mortgage foreclosure or property-tax sale?

This page covers a mortgage foreclosure. California home loans commonly use a deed of trust, so most mortgage foreclosures are nonjudicial: there is no lawsuit, and the trustee named in the deed of trust runs the process. Read California Courts’ explanation of nonjudicial foreclosures.

A property-tax sale is a different process with its own notice and deadlines. The mortgage dates below do not tell you when a tax sale can happen. Follow the tax notice and contact the office it names; if you are unsure which county office applies, have title or escrow confirm the parcel’s county.

The City of San José incorporated-area geometry overlaps Santa Clara and Alameda County polygons, while the separate Census San Jose place geometry overlaps Santa Clara County only. These city-level sources differ at a small edge and do not identify an individual parcel’s county. California mortgage foreclosure notices and deadlines

The trustee records a notice of default. After a 90-day period to catch up, a notice of sale can follow. That sale notice must be posted, published, and recorded at least 20 days before the public auction, called a trustee’s sale. The notices for your property show which stage you have reached.

You can usually reinstate by catching up on the missed payments and allowed costs until five business days before the sale. You can pay off the loan up to the sale itself. Ask the lender or trustee for the current payoff and confirm how the deadline applies to your property.

A trustee may postpone a sale at the lender’s instruction or by agreement. For one-to-four-unit homes, state law also allows limited 45-day postponements tied to a broker listing and a qualifying purchase agreement; that extra time does not apply to every sale. After a nonjudicial trustee’s sale, there is no right to redeem the house. Have the title company or an attorney confirm the current date and payoff rather than relying on an estimate.

If the payoff is the problem

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.

Ask the lender for a current payoff statement and have the title company review title and the amounts needed for closing. Any lender decision depends on that lender and the facts for your property.

You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront. A separate property-tax sale notice still has its own deadline; do not assume a sale agreement changes that date.

What happens next

  1. Tell us the San Jose property address and share the notice or trustee-sale date you have.
  2. We review the house as-is and give you written offer terms before you commit.
  3. If you choose to proceed, a title company reviews title, payoff, and closing details with the parties.
  4. Confirm the current trustee-sale date and payoff with the trustee, lender, title company, or an attorney.

It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.

San Jose county offices and sale-date checks

Confirm the property’s county for its exact address before using county records. For a mortgage trustee’s sale, the trustee named in the notice is the contact for the current sale date. For a property-tax notice, follow that notice and contact the office it identifies; mortgage deadlines do not apply.

Compare possible sale proceeds

Use your own sale, cost, and payoff assumptions to compare estimated net proceeds. The calculator is a planning estimate, not a property-specific offer or payoff statement.

Questions about selling before foreclosure in San Jose, CA

Can I sell my San Jose house before a trustee's sale?

Often, yes, if the payoff, title review, and closing can be completed before the sale. If a trustee's sale is scheduled, tell us the date right away so we can try to close before it. The notices for your property and the current date control.

What are the deadlines in a California mortgage foreclosure?

After a notice of default is recorded, a 90-day period to catch up comes before a notice of sale can follow. The notice of sale must be posted, published, and recorded at least 20 days before the sale. You can usually reinstate by catching up until five business days before the sale, or pay off the loan up to the sale itself. Confirm the dates and payoff for your property with the trustee, lender, title company, or an attorney.

Is a mortgage trustee’s sale the same as a property-tax sale?

No. This page covers a mortgage foreclosure and its trustee-sale dates. A property-tax sale is separate and has its own notice and deadlines. Follow the tax notice and contact the office named there; do not apply mortgage foreclosure dates to a tax-sale notice.

What if my payoff is more than my San Jose house is worth?

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before. Ask the lender for a current payoff statement and have the title company review the title and amounts needed for closing. Any lender decision depends on the lender and facts for the property.

How do I know whether to use Santa Clara or Alameda County records?

The City of San José incorporated-area geometry overlaps Santa Clara and Alameda County polygons, while the separate Census San Jose place geometry overlaps Santa Clara County only. These city-level sources differ at a small edge and do not determine an individual parcel’s county. Ask title or escrow to confirm the county for the exact address before relying on county records.
