Can I sell my New Mexico house while it is in foreclosure?

You may still be able to sell before the foreclosure sale if the closing pays the mortgage and resolves the other claims against the house. New Mexico foreclosures go through district court. The sale date matters: a court-ordered sale can change what you own and how much time remains. New Mexico has a separate right to redeem after a judicial sale, but a mortgage can shorten that period substantially. Selling first may help protect any equity you have. Can I sell a New Mexico house with tenants still living there?

Yes. A sale does not automatically end the rental agreement; the new owner takes over its obligations. Give the tenant written notice of the ownership change. For an ordinary month-to-month tenancy, ending it requires written notice at least 30 days before the periodic rental date stated in the notice. For a week-to-week tenancy, the minimum is seven days before the termination date. A fixed lease and any applicable local rules still matter.

Can an inherited Santa Fe house be sold before probate is finished?

Often, yes. The court appoints a personal representative and issues letters giving that person authority to handle the estate. The representative can generally sell the house during probate, subject to the will, any court restrictions, and the estate's debts. Can I sell a New Mexico house with code violations?

Open violations do not disappear just because the owner changes. If a municipality has declared a building dangerous, an existing removal order, case, or lien may affect the sale. New Mexico municipalities can order dangerous buildings removed and put the reasonable removal cost on the property as a lien.
