Can I Sell My Selmer House in Foreclosure?

If a trustee's sale is scheduled, tell us the date right away so we can try to close before it.

Often, yes: you may be able to sell before the foreclosure sale if the closing can be completed in time. The notice, lender payoff, title work, and people required to sign affect the timing.

How we help

A written offer and a title-company closing

We give you a written cash offer and written terms before you commit. If you choose to move forward, a title company reviews ownership, lender payoff, liens, and the closing details. You can ask about a cash offer before you have every document in hand.

When you sell to us, we pay the closing costs, including Tennessee's realty transfer tax. Your mortgage payoff, liens, back taxes, and share of current property taxes are separate.

Which sale is involved?

Mortgage foreclosure and property-tax sales have different notices

Mortgage or deed-of-trust foreclosure

Many Tennessee home loans use a deed of trust. When it includes a power of sale, the trustee can sell the house at public auction without a court case. Under the usual notice rules in effect since July 1, 2025, the sale notice must run at least two times in a newspaper published in the county, with the first newspaper notice at least 20 days before the sale. A third-party internet posting company must post it online for at least 20 days in a row. The trustee must mail you a copy by registered or certified mail by the date of the first newspaper notice.

Unless the loan papers forbid it, the sale can be postponed one or more times without a new newspaper notice, but it must still happen within one year of the original date. Each new date must be announced at the scheduled sale and posted online unless the delay is less than five days. If the sale is pushed back more than 30 days, the new date, time, and place must be mailed to you at least 10 days before the sale. Check the notice and loan papers for the current date and instructions.

For a sale under a deed of trust or mortgage without a court judgment, Tennessee law gives you two years after the sale to redeem the property unless the deed of trust or mortgage expressly waives that right. A court-ordered sale has different rules. That possible after-sale right is not extra time to close before a scheduled sale. See Tenn. Code Ann. §§ 35-5-101 and 66-8-101, including 2025 Public Chapter 515 for the updated notice rules.

Property-tax delinquency

A county property-tax matter is separate from a lender's trustee sale. Use the date and instructions on the tax notice or court papers; do not apply a mortgage-sale deadline to a tax-sale notice. The McNairy County Trustee can answer questions about the property-tax account, and the Chancery Court Clerk & Master can route questions about court papers.

If the payoff is the problem

Ask about the lender payoff and other amounts due

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.

Ask the lender for a current payoff. The title company can review the lender's figure and any liens or property-tax amounts as part of the closing work.

You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront. Keep following any date or instruction on a foreclosure or tax notice while you compare your options.

What happens next

Talk, review written terms, then decide

  1. 1. Talk through the property

Tell us the address, condition, the date on any notice, and what you know about the payoff. You can call before you have every document.

  2. 2. Review a written offer

We give you a written cash offer and written terms before you commit. Take time to read what the agreement says before deciding.

  3. 3. Work toward closing

If you choose to proceed, a title company checks the ownership and payoff details and coordinates the closing with the people involved.

It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.

Questions and contact

Foreclosure questions in Selmer and McNairy County

Can I sell my house before a Tennessee foreclosure sale?

Often, yes, if closing can happen before the sale. If a trustee's sale is scheduled, tell us the date right away so we can try to close before it. The current notice, lender payoff, title work, and required signatures affect whether a closing can happen in time.

What notice comes before a Tennessee trustee sale?

Under the usual notice rules in effect since July 1, 2025, notice must run at least twice in a newspaper published in the county, with the first notice at least 20 days before the sale. A third-party internet posting company must post it online for at least 20 days in a row, and the trustee must mail you a copy by registered or certified mail by the date of the first newspaper notice. Check the notice for your property and confirm the current sale date with the trustee.

Can a Tennessee trustee sale be postponed?

Unless the loan papers forbid it, the sale can be postponed one or more times without a new newspaper notice, but it must still happen within one year of the original date. A new date is announced at the scheduled sale and posted online unless the delay is less than five days. If the sale is pushed back more than 30 days, the new date, time, and place must be mailed to you at least 10 days before the sale. Check the actual notice and loan papers; do not assume a date changed.

Is a property-tax sale the same as a mortgage foreclosure?

No. A county property-tax matter is separate from a lender's mortgage or deed-of-trust sale, so use the tax notice and court papers for their own dates. Contact the McNairy County Trustee about the property's tax account. If you have court papers, the Chancery Court Clerk & Master is a local court-office route for questions about where to direct them.

What if the mortgage payoff is more than the house is worth?

Ask your lender for a current payoff. The title company can review the payoff and other amounts due as part of the closing work. Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.

What happens after I ask about a cash offer?

We talk through the property and your timing, then give you a written cash offer and written terms before you commit. If you choose to proceed, a title company reviews ownership and payoff details and coordinates closing.
