New Jersey mortgage-foreclosure steps

These are general state deadlines, not a countdown for your property. Use the dates in your notices and court papers, and confirm your current case status.

  1. 1. Notice before the court case

    Before filing, the lender must send a Notice of Intention to Foreclose. That notice gives you 30 days to catch up on the debt or ask for foreclosure mediation before the lender can file in court.

  2. 2. The complaint and response date

    After you are served with the complaint, you have 35 days to answer it. If you do not answer or contest the case, it is treated as uncontested. In an uncontested residential case, the lender normally must send a separate notice at least 14 calendar days before submitting proofs for final judgment.   3. 3. Judgment and sheriff's sale

    After final judgment, the sheriff can sell the house at a public auction. The sale must be advertised for at least four weeks, and the sheriff has 150 days from the writ of execution—the court order authorizing the sale—to hold it.
