If a New Jersey foreclosure is underway

You may still be able to sell before the sheriff's sale, but New Jersey foreclosure is a court process and the dates on your notices matter. After a lender's Notice of Intention to Foreclose, you have 30 days to catch up on the debt or ask for mediation before the lender can file in court. After service of the complaint, you have 35 days to answer. In an uncontested residential case, the lender normally gives at least 14 calendar days' notice before submitting proofs for final judgment, explaining how to get the amount needed to catch up.

After final judgment, the sheriff advertises the sale for at least four weeks and must hold it within 150 days of the writ of execution. You may ask for two postponements, each up to 30 calendar days; the lender may also receive two. One additional postponement is allowed if both sides agree, and a court may order more for good cause. After the sale, you generally have 10 days to redeem the house by paying the full amount due, including the judgment and sale costs. Free foreclosure mediation is available through the courts.
