New Jersey mortgage foreclosure steps

  1. Before filing a foreclosure complaint, the lender must send a Notice of Intention to Foreclose. You then have 30 days to catch up on the debt or ask for mediation before the lender can file in court.
  2. After you are served with the complaint, you have 35 days to answer. If you do not answer or contest the case, it may proceed as uncontested. In an uncontested residential case, the lender normally must give at least 14 calendar days’ notice before submitting proofs for final judgment, explaining how to get the amount needed to catch up.
  3. After final judgment, the sheriff can sell the house at a public auction called a sheriff’s sale. The sale must be advertised for at least four weeks, and the sheriff has 150 days from the writ of execution to hold it.
  4. You can ask the sheriff for two postponements, each up to 30 calendar days. The lender can get two as well; one more is allowed if both sides agree, and a court can order more for good cause.
  5. After the sale, you generally have 10 days to redeem the house by paying the full amount due, including the judgment and sale costs. This is a post-sale period, not extra time before the auction.
