Helpful Connecticut rules
The Probate Court appoints an executor or administrator to handle the estate. An executor may sell real estate without court approval only when the will gives that power; otherwise, the executor or administrator needs the Probate Court’s approval before selling.
The appointed representative can ask the court for permission with a petition that includes the purchase contract and proof of fair market value, such as an appraisal or market analysis. If you need an estate attorney, we can help you find one.
For a taxable home sale of $2,000 or more, Connecticut charges a real estate conveyance tax when the deed is recorded. The state rate is 0.75% on the price up to $800,000, 1.25% on the part from $800,000 to $2.5 million, and 2.25% on any part above $2.5 million. Every town also charges a 0.25% municipal tax; some eligible towns may add up to another 0.25%.
State law puts these taxes on the seller, and they are paid when the deed is recorded. Some transfers are exempt, including certain home sales for less than the mortgage and property-tax debt; the closing attorney can check whether an exemption fits your sale.
When you sell to us, we pay the closing costs, including the Connecticut state and municipal real estate conveyance taxes.
