Maine rules that affect a sale

Transfer tax and estate authority

Maine real estate transfer tax

Maine taxes each deed at $2.20 for every $500 of value or fraction of $500. The law splits the tax evenly between the seller and buyer. On a $100,000 sale, that is $440 total, or $220 for each side. Since November 1, 2025, the part of the value above $1 million carries an additional $3.80 per $500. Some transfers are exempt, but exemptions have conditions and an ordinary sale to a buyer usually does not qualify.

When you sell to us, we pay the closing costs, including the real estate transfer tax. Your mortgage payoff, liens, back taxes, and share of current property taxes are separate.

Selling an inherited house

The person appointed by the Probate Court—the personal representative—has authority to act for the estate. Maine law generally lets that representative sell estate land after appointment and issuance of letters, unless the will or a court order limits the power. A court-supervised estate may have additional limits. We can discuss a sale with the appointed representative and work alongside the estate's attorney.
