Nevada mortgage foreclosures on loans secured by a deed of trust use a trustee sale, without a court case. A sale related to delinquent property taxes is a different process with its own notice and dates. Do not use the mortgage deadlines below to calculate a property-tax sale date; follow the tax notice and check with the office named there.
For a mortgage foreclosure, the trustee records a notice of default and election to sell with the county recorder and mails you a copy. The trustee cannot sell unless the missed payments remain unpaid for 35 days after that notice. If you live in the home, the notice must include information about foreclosure mediation. Within 30 days after it is served, you can waive mediation or ask the district court for it. Requesting mediation costs a $25 filing fee plus your share of the mediator's fee. If you file, pay, and serve the request on time, the trustee cannot move ahead with the sale until mediation is finished.
At least three months after the notice of default is recorded, the trustee can give notice of sale. That notice is recorded, mailed or delivered to you, posted in a public place in the county for 20 days, and printed in a county newspaper once a week for three weeks. A postponement can be announced at the sale; after three spoken postponements, a new sale date needs a new notice. Confirm any current date or postponement with the trustee named in your notice. Once the trustee's sale happens, Nevada law gives no right to buy the house back.
