Nevada real property transfer tax in Clark County

When a deed is recorded, Clark County charges $2.55 for each $500 of value or part of $500. The value is generally the full purchase price. Nevada law makes the buyer and seller each responsible for the whole tax. The sale agreement can say who will pay, but the county may still collect from either party.

Nevada deed-of-trust foreclosure and a trustee's sale

Often, yes: you may be able to sell before a trustee's sale if the payoff, title work, and closing can be completed in time. A deed-of-trust foreclosure uses a trustee and can proceed without a court case. A property-tax sale is a separate process with its own notice and dates.

The trustee records a notice of default and election to sell with the county recorder and mails you a copy. The trustee cannot sell unless the missed payments remain unpaid for 35 days after that notice. If you live in the home, the notice must include foreclosure-mediation information. Within 30 days after it is served, you can waive mediation or ask the district court for it; asking costs a $25 filing fee plus your share of the mediator's fee. If you file, pay, and serve the request on time, the trustee cannot move ahead with the sale until mediation is finished.

At least three months after the notice of default is recorded, the trustee can give notice of sale. That notice is recorded, mailed or delivered to you, posted in a public place in the county for 20 days, and printed in a county newspaper once a week for three weeks. A postponement can be announced at the sale; after three spoken postponements, a new sale date needs a new notice. Nevada law gives no right to buy the house back after the trustee's sale. Use the current notice and confirm the date with the trustee named there.
