Nevada tenant rights, possession, and security deposits

A sale changes who owns the house; it does not by itself cancel an existing rental agreement or make the property vacant. The lease, the tenant's occupancy, any notice, and the deposit handoff remain separate parts of the sale.

Nevada rental-agreement and deposit rules — NRS 118A

Unless the buyer and tenant agree to change or end the rental agreement, it continues after the sale, and the buyer takes over the landlord's rights and duties under it. The sale itself does not end the tenant's right to occupy under the continuing agreement.

In a voluntary sale, the seller must transfer the tenant's remaining security deposit to the buyer before recording the deed. The seller must notify the tenant in writing of the new landlord's name, address, and phone number and of the deposit transfer. The buyer must accept the deposit and cannot require a new one during the rental agreement.

Within 30 days after the sale, the new owner must tell the tenant where to pay rent, that the rental agreement continues, and how much security deposit is being held.

Notice to end periodic tenancies — NRS 40.251

To end a month-to-month tenancy, a landlord must give at least 30 days' notice. A week-to-week tenancy takes at least 7 days' notice. These are notice periods for ending periodic tenancies; a sale by itself is not notice that ends the rental agreement or gives the seller vacant possession.

A month-to-month tenant who is 60 or older or has a disability can ask in writing for 30 more days. The tenant's age or disability does not change the fact that a sale alone does not end the lease.
