A Rhode Island lender may foreclose through court or use a power of sale in the mortgage. For a covered first mortgage on an owner-occupied home with one to four units, the lender normally must take part in a free mediation conference through a Rhode Island HUD-approved housing counseling agency before a power-of-sale foreclosure. The conference is to be scheduled within 60 days after notice is mailed. Reverse mortgages, defaults on or before May 16, 2013, and other statutory exceptions are excluded.
Before a power-of-sale auction is advertised, the lender must send the owner notice by certified mail. For a typical homeowner loan, that is at least 30 days before the first newspaper notice. The sale notice then runs in a newspaper once a week for three weeks, starting at least 21 days before the sale. A completed sale under the statutory power of sale ends the owner's right to redeem the house.
If a foreclosure sale is scheduled, tell us the date right away so we can try to close before it.
