Can I sell my Newark house before foreclosure?
If a foreclosure sale is scheduled, tell us the date right away so we can try to close before it.
Yes. A New Jersey mortgage foreclosure goes through court. You may still be able to sell before the Essex County Sheriff’s sale if the payoff, title work, and closing can be completed in time. The notices and court record show the stage of the case; the payoff and time left affect what can happen next.

How we help you work toward closing
We review the house as-is and give you a written offer and written terms before you commit. If you choose to move ahead, a title company reviews title, mortgage payoff, and other recorded claims while we work toward a title-company closing before the scheduled sale.
You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront.
When you sell to us, we pay the closing costs, including New Jersey's realty transfer fee and any applicable graduated percent fee. Your mortgage, liens, back taxes, and share of current property taxes are separate from those closing costs; payoffs are handled through the closing.
Mortgage foreclosure or tax sale?
This page covers a lender’s mortgage foreclosure. In New Jersey, that case goes through the courts and can lead to a sheriff’s sale. A sale notice for unpaid municipal property taxes is a different process with its own dates. Read the notice and contact the office named there; do not use mortgage-foreclosure deadlines for a tax sale.
New Jersey mortgage-foreclosure steps
- Before filing a foreclosure complaint, the lender must send a Notice of Intention to Foreclose. You then have 30 days to catch up on the debt or ask for mediation before the lender can file in court.
- After you are served with the complaint, you have 35 days to answer. If you do not answer or contest the case, it may proceed as uncontested. In an uncontested residential case, the lender normally gives at least 14 calendar days’ notice before submitting proofs for final judgment, explaining how to get the amount needed to catch up.
- After final judgment, the sheriff can sell the house at a public auction called a sheriff’s sale. The sale must be advertised for at least four weeks, and the sheriff has 150 days from the writ of execution to hold it.
- You can ask the sheriff for two postponements, each up to 30 calendar days. The lender can get two as well; one more is allowed if both sides agree, and a court can order more for good cause.
- After the sale, you generally have 10 days to redeem the house by paying the full amount due, including the judgment and sale costs. This period comes after the auction, not before it.
These are separate steps, not one countdown for every property. Free foreclosure mediation is available through the New Jersey Courts.

If the payoff is the problem
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.
Ask the lender for a current payoff. The title company can review it with recorded liens and other amounts tied to the property. Any lender decision about a reduced payoff depends on that transaction.
What happens next
- Tell us the property address and what your notice says. Call or use the form above.
- We review the house and give you a written offer and written terms before you commit.
- If you choose to proceed, the title company reviews title and payoff details with the parties involved.
- We work toward a title-company closing before the scheduled sale when the payoff, title, and timing allow. Check the current sale date with the sheriff or your attorney.
It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.
Essex County sale information and local records
The Essex County Sheriff posts foreclosure listings, but sale dates can change. Match the property and case information, then confirm the current date with the sheriff or your attorney. For recorded deed, mortgage, or lien-record inquiries, contact the Essex County Register; its records do not verify a payoff or the status of a particular foreclosure.
Compare possible sale proceeds
Use your own sale and payoff assumptions to estimate possible net proceeds. The calculator is a planning estimate, not a property-specific offer.

Can I sell my Newark house before an Essex County sheriff’s sale?
If a foreclosure sale is scheduled, tell us the date right away so we can try to close before it. A sale may still be possible if the payoff, title work, and closing can be completed before the current sale date.
What deadlines apply to a New Jersey mortgage foreclosure?
The steps include 30 days after a Notice of Intention to catch up or ask for mediation before the lender files in court, 35 days to answer after service of the complaint, and a sheriff’s sale after final judgment. Later sale-advertising, adjournment, and redemption periods are separate steps. The dates in your notices and court record show where your case stands.
Is a mortgage foreclosure the same as a property-tax sale?
No. A lender’s mortgage foreclosure and a sale process involving unpaid municipal property taxes are separate matters with different notices and deadlines. Follow the process named in your notice and contact the office named there; do not apply mortgage-foreclosure dates to a tax sale.
Is free foreclosure mediation available in New Jersey?
Yes. Free foreclosure mediation is available through the New Jersey Courts. The court’s foreclosure information explains how to ask for mediation and what to do with the dates in your case notices.
