Estate authority and Rhode Island’s conveyance tax

Selling a Warwick house through an estate

Warwick’s Probate Division handles probate matters affecting Warwick residents. The court appoints the executor named in a will or an administrator when there is no will. The court’s letters show who can act for the estate. If the will gives the executor a power of sale, the executor can usually sell under it. If the will leaves the house to a specific person, that person must agree in writing. Without a power of sale, the executor or administrator asks the probate court for a license to sell; the court can set a minimum price.

Rhode Island real estate conveyance tax

For a deed transfer with more than $100 in payment, Rhode Island charges a real estate conveyance tax when the deed is recorded. Since October 1, 2025, the rate is $3.75 for each $500 of the price, or any part of $500. The price includes a mortgage or lien that stays on the property. For residential sales above $824,000 in 2026, an additional tax at the same rate applies to the amount above that threshold. The state adjusts the threshold for inflation each year. By law, the seller pays unless the parties agree otherwise.

When you sell to us, we pay the closing costs, including Rhode Island's real estate conveyance tax.

No agent commissions when you sell to us. No fees.

Your mortgage payoff, liens, back taxes, and share of current property taxes are separate.
