Kentucky rules
A personal representative—the executor or administrator—must be appointed by the court before selling estate property. If the will gives that person power to sell real estate, they can usually sell without a separate court order.
If the will does not give that power, the personal representative can ask District Court for an order to sell, with notice to everyone who has an interest in the house. The order must be final and the time to appeal must expire before the property can be transferred; a certified copy is recorded with the deed. A surviving spouse may also have rights in the house even if not named on the deed. Kentucky’s updated surviving-spouse rule took effect July 15, 2026.
The will, appointment papers, and any court order shape the next step. If you need an estate attorney, we can help you find one. Not sure? Call us — we’ll sort it out with you.
Kentucky’s real estate transfer tax is 50 cents for each $500 of value or fraction of $500. State law says the seller (the grantor) owes it, and the County Clerk collects it before the deed can be recorded. The value includes the full price paid, including any liens the buyer takes over. Some transfers are exempt, and recording fees are separate; the title company can confirm whether an exemption applies to your sale.
When you sell to us, we pay the closing costs, including the Kentucky real estate transfer tax. No agent commissions when you sell to us. No fees.
